C’est là en effet que surgissent les principales difficultés en éthique clinique. Le modèle classique d’argumentation de Stephen Toulmin, s’il permet de formaliser les arguments, devra néanmoins être révisé si l’on veut l’appliquer à ce type de situations. En effet, trop unilatéral, il ne permet pas dans sa forme initiale d’intégrer la possibilité du désaccord, et notamment un pluralisme axiologique. C’est pourquoi nous proposons un modèle plus dialogique, afin d’intégrer la pluralité des points de vue. Ce nouveau modèle d’argument proposé dans cet article, plus proche des situations réelles, permet d’analyser plus finement nombre de délibérations éthiques et notamment de comprendre l’origine de nombreux malentendus et conflits.How should we think about conflicting deliberations in clinical ethics and more precisely those where the different participants do not share the same values or norms? Stephen Toulmin's classic argumentation model, while allowing arguments to be formalized, will nevertheless have to be revised if it is to be applied to this type of situation. Indeed, too unilateral, it does not allow in its initial form to integrate the possibility of disagreement, and in particular an axiological pluralism. This is why we propose a more dialogical model, in order to integrate the plurality of points of view.
